How the Calculator Works
The calculator estimates the value of your potential civil claim based on two categories of damages: economic and non-economic.
Economic Damages
Economic damages are measurable financial losses related to the abuse. These may include past medical bills, therapy costs, and counseling, future treatment and mental health services, lost wages or diminished earning capacity, and relocation expenses or home security measures.
These figures are entered directly into the calculator and form the base of your settlement estimate.
Non-Economic Damages
Non-economic damages reflect the emotional and psychological impact of the abuse. These are calculated using a multiplier, which is a number typically between 1.5 and 5.0 based on the severity of trauma.
You’ll use two sliders to rate the level of psychological trauma and the degree of emotional suffering and long-term impact.
The average of these ratings is used to generate a multiplier. This multiplier is then applied to your total economic damages to estimate non-economic compensation.
Additional Factors Included
A base “nuisance settlement” of $1,000 is included, which reflects the minimum estimated value often offered in civil claims with limited economic damages.
California, Nevada, and Texas Law
California: In most civil sexual abuse cases, California law does not place a cap on non-economic damages. The multiplier can be applied freely, and survivors may be eligible for substantial compensation based on the harm suffered and evidence presented.
Nevada: Nevada does not cap non-economic damages in civil sexual abuse or assault claims. The $350,000 cap under NRS 41A.035 applies only to medical malpractice cases against healthcare providers, not to sexual assault claims against individuals or institutions outside the medical malpractice context. Your pain and suffering compensation is calculated without a statutory limit.
Texas: Texas law does not impose a cap on non-economic damages in civil sexual abuse or assault cases filed against private defendants. Survivors may recover the full calculated amount for pain and suffering based on the evidence and severity of harm. Additionally, because sexual assault qualifies as a felony under Texas law, the usual cap on exemplary (punitive) damages under Texas Civil Practice & Remedies Code § 41.008 does not apply, meaning juries may award uncapped punitive damages in these cases as well.
