A civil lawsuit is separate from criminal prosecution and gives survivors direct control over their pursuit of justice. You do not need a criminal conviction to file a civil claim, and the standard of proof is lower. Understanding your options is the first step toward holding every responsible party accountable.
Civil claims are separate from criminal cases. Even if the district attorney declines to prosecute, or if the criminal case results in acquittal, you can still pursue a civil lawsuit. The burden of proof in civil court is “preponderance of the evidence,” which is significantly lower than the criminal standard of “beyond a reasonable doubt.”
Time limits apply, but exceptions exist for survivors. In California, survivors of sexual assault generally have 10 years from the date of the assault (or 3 years from discovery of related injuries) to file a civil claim. Nevada allows 20 years for certain sexual abuse claims. In Texas, the statute of limitations is 5 years for sexual assault, with extended deadlines for minors. These windows have been expanded in recent years, so even older cases may still be viable.
